ChaCha – Markenproblem für HTC
Möglicherweise hat man bei HTC bei der Namensgebung des HTC ChaCha ein klein wenig “geschlampt”. Die Firma ChaCha Search Inc. besitzt die Markenrechte für den Begriff “ChaCha” in den USA und Europa. In den USA hat ChaCha nun vor einigen Tagen Klage gegen HTC eingereicht. ChaCha ist ein Echtzeit-Antworten-Service. Und bietet unter anderem auch eine Android App an. Das HTC ChaCha ist eines der beiden Facebook-Smartphones von HTC.

Entscheidende Frage ist also, ob die Dienstleistungen einer Suchmaschine derart verwechslungsfähig mit einem Smartphone sind, dass der zusätzliche Wortbestandteil “HTC” diese Verwechslungsfähigkeit nicht neutralisieren kann.
