OLG HH: Portionsflasche

Eine Portionsflasche ist eine Portionsflasche. Und nichts anderes. Trotz Markeneintrag und Bekanntheit der papierumwickelten Underberg-Flaschen dürfen handelsübliche 700ml-Flaschen mit grünem Papier umwickelt werden. Das stellte das Hamburger Oberlandesgericht (Az: 5 U 105/05 ) kürzlich in einem Berufungsverfahren des Spirituosenherstellers klar.
