Vivid – Handy vs. Porno

Die US-amerikanische Pornoproduktionsfirma Vivid Entertainment hat dem Smartphone-Hersteller HTC in einem Brief rechtliche Schritte angedroht, wenn das taiwanische Unternehmen weiterhin das Markenrecht des Pornokonzerns verletzt. Streitpunkt ist das HTC Vivid.

In Europa muss sich die Vivid Entertainment, LLC allerdings hinten anstellen. Die eigene Markenanmeldung aus dem Jahr 2009 (Registernummer: 8410003) ist mit einem Widerspruchsverfahren behaftet. Die britische Vivid Imaginations Limited weist Markenrechte für die Wortmarke “VIVID” (Registernummer: 2240844) aus dem Jahr 2001 auf.

Die HTC Corporation ist mit der Marke “HTC VIVID” im europäischen Markenregister noch nicht präsent. Beim US Patent & Trademark Office wird die Anmeldung für die Nizzaklasse 09 mit Priorität vom 06.04.2011 unter der Seriennummer 85288096 geführt.
