LEGO verliert in Kanada

Vor den kanadischen Supreme Court in Ottawa hat der dänische Spielwarenhersteller LEGO das Verfahren gegen das kanadische Unternehmen Mega Bloks Inc. verloren.

LEGO hatte die kanadische Konkurrenz wegen Markenrechtsverletzung verklagt, da man das Aussehen der Verbindungselemente der Spielsteine kopiert sah.

Das Gericht urteilte:

It said “functionality” does not confer a trademark.

“The monopoly on the bricks is over and Mega Bloks and Lego bricks may be interchangeable in the bins of the playrooms of the nation,” the Supreme Court said in its unanimous decision.
