NFL stoppt Gewinnspiel der Illinois Lottery


Der Miami Herald berichtet über die Einstellung eines Gewinnspiels der Illinois Lottery. Auf Klage der National Football League (NFL) musste das Spiel, bei dem Karten für den Super Bowl zu gewinnen waren gestoppt werden.

Um Markenrechtsverletzungen vorzubeugen griff man zu folgendem Trick:

In radio ads for the promotion, they even made sure that the word “Super” could be heard, but where listeners might have expected “Bowl” there was only cheering.

Woraufhin der NFL folgende Argumentation einfiel:

NFL spokesman Brian McCarthy said it doesn’t matter if the exact words “Super Bowl” appear in any ads.

“If you are describing what everybody perceives as the Super Bowl … that is a trademark infringement,” he said.

Unabhängig davon erlaubt die NFL generell keine Ticketvergabe für NFL Spiele zu Promotionzwecken ohne ausdrückliche Genehmigung seitens der Liga.
