Its counsel Hemant Singh contended that Societe des Produits Nestle S A, Switzerland has the exclusive right to use trademark Nestle and its logo and Nestle India Ltd is authorised licensee in India to use the trademark and logo.
The company, which produces items such as chocolate, baby foods, coffee and noodles, contended the use of Nestle trademark and logo by the footwear company may cause confusion and deception among customers that there is some association or nexus between Nestle India and Nestle Footwear.
